Welcome to AlbertasBest.ca. These Terms of Service (“Terms”) govern your access to and use of our website and services. By accessing or using AlbertasBest.ca, you agree to be bound by these Terms.

By creating an account, submitting a business listing, posting reviews, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. Eligibility

You must be at least 18 years old to use AlbertasBest.ca. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Business Listings

3.1 Eligibility for Listing

Only businesses with a physical location in Alberta, Canada are eligible for listing on AlbertasBest.ca. Home-based businesses operating in Alberta are permitted.

3.2 Types of Listings

We offer both free and paid premium listing options. Premium listing features, pricing, and terms are described separately on our website.

3.3 Listing Submission

When you submit a business listing, you must provide:

  • Accurate and complete business information
  • Valid contact details
  • Truthful description of products or services
  • Appropriate business category selection

3.4 Listing Review and Approval

All listings are subject to review by AlbertasBest.ca. We reserve the right to:

  • Review and approve or reject any listing submission
  • Edit listing content for clarity, accuracy, or compliance
  • Remove or suspend listings that violate these Terms
  • Request verification of business information

There is no guarantee that your listing will be approved or published. We reserve complete discretion in determining which listings appear on our platform.

3.5 Listing Accuracy

You are responsible for maintaining accurate and up-to-date listing information. You must promptly update your listing if any information changes (hours, contact details, services, etc.).

4. User Accounts

4.1 Account Creation

To submit a business listing, you must create an account by providing:

  • Your name
  • Valid email address
  • Company name
  • Business location
  • Other required information

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

5. User-Generated Content

5.1 Reviews, Photos, and Comments

Users may post reviews, upload photos, and submit comments about businesses listed on AlbertasBest.ca.

5.2 Content Ownership and License

You retain ownership of content you submit. However, by posting content, you grant AlbertasBest.ca a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your content in connection with our services.

5.3 Content Standards

All user-generated content must:

  • Be truthful and based on genuine experience
  • Not contain false, misleading, or defamatory statements
  • Not include profanity, hate speech, or discriminatory language
  • Not violate any third-party rights
  • Comply with all applicable laws

5.4 Content Moderation

We reserve the right to:

  • Review, edit, or remove any user-generated content
  • Moderate comments and reviews for compliance
  • Take action against users who violate content standards

5.5 No Obligation to Monitor

We are not obligated to monitor user-generated content and do not endorse any opinions expressed by users.

6. Payment Terms

6.1 Premium Listings

If you purchase a premium listing or other paid services:

  • Fees are described on our website and are subject to change
  • Payment is processed securely through PayPal or Stripe
  • All fees are non-refundable unless otherwise stated
  • Premium listing terms (duration, features) are specified at purchase

6.2 Payment Processing

We use third-party payment processors (PayPal and Stripe). Your payment information is subject to their respective privacy policies and terms of service.

7. Intellectual Property

7.1 Our Property

AlbertasBest.ca, including its design, logos, text, graphics, and software, is owned by us and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

7.2 Your Property

You represent and warrant that you own or have rights to all content you submit and that your content does not infringe on any third-party rights.

8. Prohibited Conduct

You agree NOT to:

  • Provide false, inaccurate, or misleading information
  • Impersonate any person or entity
  • Post fake reviews or manipulate ratings
  • Use automated systems (bots, scrapers) to access our services
  • Attempt to gain unauthorized access to our systems
  • Harass, threaten, or abuse other users

  • Violate any applicable laws or regulations
  • Use our services for any illegal purpose

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

9.1 NO WARRANTIES

ALBERTASBEST.CA IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 NO GUARANTEE OF ACCURACY

WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF:

  • Business listing information
  • User reviews, ratings, or comments
  • Search results or recommendations
  • Availability or quality of listed businesses

9.3 USER RESPONSIBILITY

YOU ACKNOWLEDGE THAT:

  • Business information is provided by third parties and may be inaccurate or outdated
  • User reviews reflect individual opinions and may not be reliable
  • You are solely responsible for evaluating businesses before engaging their services
  • You assume all risks associated with using information from AlbertasBest.ca

9.4 LIMITATION OF DAMAGES

TO THE FULLEST EXTENT PERMITTED BY LAW, ALBERTASBEST.CA AND ITS OWNERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage
  • Any damages arising from your use or inability to use our services
  • Any damages resulting from interactions with businesses listed on our platform
  • Any damages resulting from user-generated content

THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.5 MAXIMUM LIABILITY

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100 CAD), WHICHEVER IS GREATER.

9.6 Third-Party Interactions

AlbertasBest.ca is a directory platform. We are not a party to any transactions or interactions between users and listed businesses. Any disputes, claims, or issues arising from such interactions are solely between you and the business. We expressly disclaim all liability for such interactions.

10. Indemnification

You agree to indemnify, defend, and hold harmless AlbertasBest.ca and its owners, employees, contractors, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit to our platform
  • Your interactions with listed businesses

11. Geographic Scope

AlbertasBest.ca exclusively lists businesses located in Alberta, Canada. Our services are intended for users in Alberta and Canada. We make no representation that our services are appropriate or available for use outside Canada.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

12.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Alberta, Canada for resolution of any disputes.

12.3 Informal Resolution

Before initiating any legal action, you agree to first contact us at privacy@albertasbest.ca to attempt to resolve the dispute informally.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting the updated Terms on our website
  • Updating the “Effective Date” at the top of this document
  • Sending email notification to registered users (for significant changes)

Your continued use of AlbertasBest.ca after changes are posted constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AlbertasBest.ca regarding use of our services.
